As Bovard concludes:
False accusations will not keep America safe. Simply because a government official suspects someone of wrongdoing proves nothing. The US government can devise a system to judge alleged terrorists without disgracing itself in the process.
The administrtation has a policy of fear-mongering and demogoguery. That might play well to the base, but in case the administration has not noticed, the base appears to be shrinking. The days are long gone when cynically invoking 9-11 will pass for viable policy.

Well said Dcat... The rule of law must prevail...
I am waiting breathlessly tro see what happens with conservatives and their views of the unitary executive, the ability to ignore congress through signing statements, and the like. I think we'll quickly realize that this is not an ideology they embrace so much as a technique for using power the appeal of which will fade significantly once their man is out of office. i will say what i aolways say in these circumstances: Imagine if Clinton had tried what Bush has done and what the GOP response would have been.
